New York City Lawyers Performance Review

Finding the Best Lawyers/Attorneys in New York City can be a headache

Article Date: June 30 2006

Since June 15 2006 New York City lawyers have to obey very strict rules on advertising their services and their online presence is limited to very strict advertising niche and for what? Is the NY state government trying to limit their online presence "from soliciting mass tort clients to sponsoring pop-up Internet ads to using celebrity voice-overs -- that the justices have taken the unusual step of ordering a 90-day public comment period before the disciplinary standards take effect. That period runs until Sept. 15, with the rules slated to take effect Nov. 1.”. A full list of all requirements and almost ridiculous limitations you can find at the NY’s official website at NYCOURTS.GOV

Interesting question is why the government tries to limit what people can see ? Is that against the freedom of speech act or it is just trying to protect small law firms that can not afford on spending some nice money on advertisements? Yeah right!

"Impose broad new time, place and manner restrictions on advertising -- apparently an effort to control advertising while staying within the bounds of the First Amendment. For instance, lawyers would be prohibited from using current client testimonials, from portraying judges, from re-enacting courtroom or accident scenes and from using courthouses or courtrooms as props. They would also be barred from using paid endorsements, and from using the recognizable voice of a non-attorney celebrity to tout the lawyer's skills.” – Is that what I think it is? The government is actively stopping "CLIENT TESTIMONIALS” so when we try to find a good lawyer in New York we must judge him only by his "good looks”, because his previous clients can not say anything about his deeds? Woow what is that ?

The New York state bar President Mark H. Alcott even said that ""For a long time there was a view that nothing could be done because the [U.S.] Supreme Court said lawyers could advertise and it was assumed that was the final word," Alcott said. "But while lawyers are free to advertise, there can be reasonable restraints on those advertisements. It is long overdue that such restraints would be imposed, and enforced, in New York." – and is "RESTRICTING” the right way to make good attorneys stand out of the crowd? Hmm.. maybe we don’t share the same opinion Mark. Sorry!

As a good New Yorker, I personally feel that this is totally unjust an all lawyers must have the rights to advertise wherever and whenever they wish. We must still keep some reasonable limitations as "Require attorneys to objectively verify the claims they make in their ads, and to include a disclaimer making clear that their past victories are no guarantee of future success. For example, an attorney who claims to have obtained the largest verdict or settlement in a particular region would be required to prove that boast.” Which may be the one of the best thing this so called "law reform” has to offer.

So what do we learn from this? How do we find good lawyers? I guess the answer to this question lies on "TELEVISON” and who wins big lawsuits but is Television saying everything and isn’t that just another "LEGAL” form of advertising? Ha that’s right people! If you think that nobody pays for those interviews Ha! You would be quite foolish to trust them.

I’ll leave you to think on that one.
